Terms of Service

Pitchguest is a software-as-a-service (SaaS) platform that helps podcast hosts find, research, and book guests using AI-powered tools. Features include guest discovery, outreach email drafting, prep doc generation, run sheet creation, and pipeline management.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

You must be at least 13 years old to use Pitchguest. By creating an account, you represent that the information you provide is accurate and that you have the authority to agree to these Terms.

You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at josh@tonesofvinyl.com if you suspect unauthorized access.

You agree not to use Pitchguest to:

• Violate any applicable law or regulation
• Harass, spam, or send unsolicited communications to third parties
• Scrape, reverse-engineer, or attempt to extract our underlying data or models
• Impersonate any person or entity
• Upload or transmit viruses, malware, or other harmful code
• Use the Service in any way that could damage, disable, or impair our infrastructure
• Attempt to gain unauthorized access to any part of the Service or its related systems

We reserve the right to suspend or terminate accounts that violate these rules without refund.

Pitchguest uses third-party AI services (including Anthropic's Claude) to generate content such as prep docs, run sheets, and outreach emails. You acknowledge that:

• AI-generated content may contain inaccuracies, errors, or hallucinations
• You are responsible for reviewing all AI-generated content before using it
• We make no warranty that AI-generated content is accurate, complete, or fit for any particular purpose
• You own the AI-generated content produced for your account; we do not claim ownership

You retain ownership of all data, notes, and information you enter into Pitchguest ("Your Content"). By using the Service, you grant us a limited license to store, process, and use Your Content solely to provide the Service to you.

You represent that Your Content does not violate any third-party rights (including privacy rights) and that you have the right to share it with us.

Certain features of Pitchguest require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or as explicitly stated in our refund policy.

We reserve the right to change our pricing with at least 30 days' advance notice. Continued use after a price change constitutes acceptance of the new pricing.

If your payment fails, we may suspend access to paid features until the outstanding balance is resolved.

The Pitchguest name, logo, software, and all associated intellectual property are owned by Tones of Vinyl, LLC. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the Service, including AI-generated content.

TO THE FULLEST EXTENT PERMITTED BY LAW, TONES OF VINYL, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service
• Any AI-generated content produced by the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct on the Service

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Tones of Vinyl, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

You may cancel your account at any time by contacting us at josh@tonesofvinyl.com. We may terminate or suspend your account at any time for violation of these Terms.

Upon termination, your right to use the Service ceases immediately. Sections 4, 7, 8, 9, 10, and 13 survive termination.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page with an updated date, or by email. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
